FramedPosters.com.au (“Framed Posters”, “we”, “us”, “our”) operates as an online marketplace platform that allows independent artists and creators (“Artists”) to upload, display, and sell their own artwork to customers.
Framed Posters does not create, produce, or own artist-uploaded content and acts solely as a neutral platform facilitating transactions between Artists and buyers.
By creating an account or uploading content to Framed Posters, Artists confirm that they are legally able to enter into this agreement and agree to be bound by these Terms & Conditions.
Framed Posters reserves the right to refuse, suspend, or terminate accounts at its sole discretion.
Artists retain ownership of their artwork and intellectual property. Framed Posters does not claim ownership of artist-uploaded content.
By uploading or listing artwork, Artists represent and warrant that:
They are the original creator of the artwork or
They hold all necessary rights, licenses, and permissions to use and sell the artwork
The artwork does not infringe any copyright, trademark, publicity, or other intellectual property rights
The artwork does not violate any applicable laws or regulations
Artists are solely responsible for the content they upload.
Framed Posters does not review, approve, verify, or endorse artwork prior to publication and does not guarantee the legality or originality of artist-uploaded content.
To the maximum extent permitted by law, Framed Posters shall not be liable for any claims, losses, damages, or legal actions arising from artwork uploaded or sold by Artists.
Framed Posters respects intellectual property rights and will respond promptly to valid notices of alleged infringement.
If Framed Posters receives a complaint or notice alleging that content infringes copyright or other intellectual property rights, we may, at our sole discretion:
Remove or disable access to the content without prior notice
Suspend or terminate the Artist’s account
Take any other action deemed appropriate
Framed Posters is not required to notify Artists prior to removal of content.
Artists who repeatedly upload content that infringes intellectual property rights may have their accounts permanently terminated.
Artists agree to indemnify, defend, and hold harmless Framed Posters, its owners, operators, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, or legal expenses (including reasonable legal fees) arising out of or related to:
Artwork uploaded or sold by the Artist
Any breach of these Terms & Conditions
Any claim that the Artist’s content infringes copyright, trademark, or other intellectual property rights
This obligation survives termination of the Artist’s account.
Framed Posters does not provide legal advice regarding copyright or intellectual property. Artists are responsible for ensuring their artwork complies with all applicable laws.
Framed Posters reserves the right to remove any content at any time, for any reason, without notice.
To the fullest extent permitted by law, Framed Posters shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the platform.
These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
